Why is CBD sometimes illegal?

Even though industrial hemp doesn’t produce enough THC to intoxicate consumers, all varieties of cannabis, including hemp, were swept into the category of Schedule 1 narcotics by the 1970 Federal Controlled Substances Act. The law defined cannabis as a substance with no accepted medical use, a likelihood for addiction, and a high potential for abuse.

In 2018, Congress passed the Farm Bill and legalized hemp cultivation, creating a pathway to remove cannabis from Schedule 1. The Farm Bill defined hemp as cannabis that contains less than 0.3% THC by weight and marijuana as cannabis with more than that amount. Hemp-derived CBD was thus removed from its Schedule 1 designation, but CBD derived from the marijuana plant is still considered federally illegal because of marijuana’s federally illegal status. Hemp is considered an agricultural commodity, but still must be produced and sold under specific federal regulations, which were not finalized when hemp was legalized.

The Farm Bill also endowed the Food and Drug Administration (FDA) with the ability to regulate CBD’s labeling, therapeutic claims, and presence in foods or drinks. Despite the Farm Bill’s passage, the FDA has issued a directive that no CBD, even hemp-derived, may be added to food or beverages or marketed as a dietary supplement. As time passes, the FDA has begun re-evaluating that stance on CBD products but has yet to revise rules or specifically regulate CBD products. The FDA’s slow movement has created further confusion on the state level. The FDA has historically been strict when it comes to health claims or content that could be understood as medical advice — and makes no exception for CBD. In July 2019, the FDA sent a letter to Curaleaf warning that the CBD maker was making unproven claims about its effectiveness in treating such conditions attention deficit/hyperactivity disorder (ADHD), Alzheimer’s disease, Parkinson’s disease, cancer, and opioid withdrawal. In April 2019, the FDA also warned three other CBD makers over making unproven health claims.

Hemp production and sale, including its cannabinoids and CBD specifically, remain tightly regulated federally. The Farm Bill provides that individual states may also regulate and even prohibit CBD cultivation and commerce. States may attempt to regulate CBD in food, beverage, dietary supplements, and cosmetic products independently of the FDA’s rules.

Alabama CBD laws

Before the 2018 Farm Bill, Alabama had a budding, though restrictive, medical CBD program in place. On April 1, 2014, Republican Gov. Robert Bentley signed SB 174, known as Carly’s Law, which allowed an affirmative defense for individuals using CBD to treat a debilitating epileptic condition. Patients could receive a prescription for possession or use of CBD only through the University of Alabama-Birmingham. This made access to CBD difficult, as the term “prescribe” is a federal term; most legalized medical marijuana states allow doctors to “recommend” it.

On May 4, 2016, Bentley signed HB 61. Known as Leni’s Law, named for Leni Young of Alabama who successfully treated her seizures with CBD. The act widened access to CBD by expanding the definition of qualifying conditions to include specified debilitating conditions that produce seizures. However, access to CBD was still highly restricted and the only FDA-approved form was GW Pharmaceuticals’ Epidiolex.

Following the 2014 Farm Bill passed by Congress and signed by President Barack Obama, the Alabama Legislature passed the Alabama Industrial Hemp Research Program Act in 2016, tasking the Alabama Department of Agriculture and Industries (ADAI) with the development of a licensing and inspection program for the production of industrial hemp. The ADAI slowly drafted and finalized regulations in September 2018, only months before the 2018 Farm Bill was signed, which broadly legalized CBD and CBD products that contained less than 0.3% THC by weight.

Following the passage of the 2018 Farm Bill, Republican Alabama Attorney General Steve Marshall affirmed the legality of CBD products that are sold by a licensed vendor and contain no more than 0.3% THC by weight. However, Marshall cautioned buyers to be careful when purchasing, as Alabama has yet to draft regulations for the testing and labeling of CBD products.

While CBD products with less than 0.3% THC are now broadly legal and available for sale and purchase in Alabama, the ADAI still regulates and licenses industrial hemp growers and processors under the 2014 Farm Bill’s rules. They will continue to operate under the pilot program until the FDA finalizes industrial hemp regulations and reviews and approves the rules submitted by the ADAI.

Relation to Federal Law

In July 2019, Republican Gov. Kay Ivey signed SB 225, which redefined and rescheduled CBD to align with federal definitions and allowed Alabama pharmacies to sell CBD products.

While the ADAI will collaborate with FDA rules to create regulations in accordance with the 2018 Farm Bill, the Alabama Industrial Hemp Research Program remains in effect. CBD products are legal, but it is illegal for growers and processors to work with industrial hemp in Alabama without a permit.

Licensing Requirements

The Alabama Industrial Hemp Research Program required applicants to submit all materials and application fees annually, including criminal background checks. Growers and processor applicants must pay a $200 application fee and a $1,000 annual fee upon approval.

Testing Requirements

At the ADAI commissioner’s discretion, the department requires regular sample lab testing to confirm that the crop or processed hemp product contains less than 0.3% THC. The grower or processor is responsible for the lab testing fee, which is approximately $200 per sample. There are no requirements for labeling or posting test results for participants in the pilot program.

Sale Regulations

There are no regulations for sales of products that meet the 0.3% THC threshold of CBD. Business or individuals that sell any cannabis product containing more than the legal amount of THC can be charged with a felony, and face a sentence of two to 20 years in prison and a find of up to $30,000. Sales of cannabis to a minor can be punishable by a 10 years-to-life sentence and a maximum $60,000 fine.

Cultivation Requirements

Participants in the Alabama Industrial Hemp Research Program are required to submit several reports regularly to the ADAI. Failure to submit any report, reporting false information, not paying fees, or growing a hemp product that tests above the legal THC limits are all in violation of ADAI regulations. These violations are subject to civil penalties up to $500 and disciplinary sanctions including revocation of an application.

Growers also are subject to existing Alabama code regarding possession, cultivation, sale, or use of cannabis above the legal THC limits. The cultivation or manufacturing of cannabis can result in a sentence of two years to life and a fine of up to a $60,000, depending on the degree of manufacture.

With stress in the U.S. on the rise, it’s no wonder more than half of Americans suffer from high blood pressure.

CBD oil has been hailed as a cure-all for a variety of conditions, but what do researchers have to say about CBD oil and blood pressure?

Does CBD oil lower blood pressure, or is it an unfounded claim? Is it possible to skip the burdensome doctors’ visits and expensive trips to the pharmacy?

We wouldn’t go that far. Hypertension is a risk factor in heart attack, stroke and type 2 diabetes. Even though it’s common, it’s a serious issue which require medical attention.

However, there are many steps you can take to naturally reduce your blood pressure, one of which may be by using CBD oil for hypertension.

What is Hypertension?

Hypertension is the medical term for high blood pressure. As blood is pumped through your blood vessels, they undergo a degree of force. If you have high blood pressure, this force can damage the walls of your blood vessels, veins and arteries.

When you visit the doctor, you’ll usually hear your blood pressure described by two numbers, like 120/70.

The first number refers to the systolic pressure, the pressure exerted when the heart contracts and pumps blood into the arteries. The second is the diastolic pressure, measured when the heart muscle relaxes between beats. In cardiology, a systolic pressure of 140, and/or a diastolic pressure of 90, is considered the boundary between normal and high blood pressure.

High blood pressure can lead to cardiovascular complications such as heart disease, heart attack, stroke, aneurysm and heart failure. The condition is exacerbated by type 2 diabetes, stress, anxiety, inflammation, high cholesterol levels, insomnia, a diet high in salt, and alcohol and tobacco use.

Lowering High Blood Pressure: CBD and Blood Pressure

High blood pressure can be naturally lowered by reducing stress, salt intake, and consumption of alcohol and tobacco. You can also lower your blood pressure by exercising regularly and eating more fruits and vegetables.

Your doctor may prescribe medications that can lower blood pressure. Many of these medications, such as calcium channel blockers and ACE-inhibitors, cause side effects like headaches, dizziness, constipation and swollen ankles. That has naturally sparked interest in non-prescription treatments for high blood pressure.

New evidence links CBD to a decrease in blood pressure. For many people, CBD oil has fewer side effects than prescription medications, too.

We spoke with Rebecca Park, registered nurse and founder of RemediesForMe.com, who told us that CBD oil tinctures made using hemp have very few side effects and are generally well tolerated.

If you are already on high blood pressure medications, however, consult your physician before using CBD oil as there may be interactions.

What is CBD Oil?

Cannabidiol, better known as CBD, is a non-psychoactive phytocannabinoid, which is a cannabinoid found in the two forms of cannabis, marijuana and hemp plants.

Commercially-available CBD oil is cannabidiol extracted from the hemp plant, often mixed with coconut or hemp oil. Unlike its marijuana-derived counterpart, this CBD oil does not contain high levels of tetrahydrocannabinol (THC), so cannabidiol does not get you high. Instead, most users report that it makes them feel relaxed and calm, among the other generally positive effects of CBD.

According to federal law, hemp-derived CBD oil is classified as having less than 0.3% THC, making it legal to purchase and use. And since hemp has minuscule amounts of THC content, CBD oil from this type of cannabis plant does not cause any of THC’s intoxicating side effects. Marijuana-derived CBD oil, whether it’s derived from sativa or indica-dominant plants, contains more than 0.3% THC as its primary active ingredient, and may make you high. It is only legal in states with recreational or medical marijuana legalization.

Though it comes in a wide variety of forms such as capsules, vape juice, powders, topical patches and lotions, and edibles like gummies, cannabidiol is most popularly consumed as a sublingual oil. You simply place a few drops of CBD oil under your tongue and let it sit for 30 to 90 seconds.

Pharmacology research has shown a wide range of potential benefits for cannabidiol. CBD oil is commonly used to treat or supplement treatment of medical conditions like chronic pain, inflammation, arthritis, multiple sclerosis, Parkinson’s disease and epilepsy. Park added that CBD oil is also commonly used by people suffering from a wide range of mental disorders.

“CBD can be effective in treating generalized anxiety disorder (GAD), social anxiety disorder, anxiety related insomnia, and post-traumatic stress disorder (PTSD),” she said.

Additionally, emerging evidence shows that CBD may use the same mechanism to treat high blood pressure as it does to reduce anxiety.

How CBD Interacts with the Endocannabinoid System and Body

The endocannabinoid system is a biological system in your body that allows cannabinoids to send and receive messages that control most of the body’s important functions. In fact, your body naturally produces cannabinoids every day.

This system has two main endocannabinoid receptors, called CB1 and CB2. THC binds directly to the CB1 receptors, affecting areas of the brain that influence memory, motor coordination and time perception, and to the CB2 receptors which affect the pain centers in your brain and manage inflammation in the body. The interaction between THC and the endocannabinoid system is what causes the psychoactive side effects that marijuana is best known for.

On the other hand, cannabidiol does not directly bind to the CB1 and CB2 receptors. Instead, it causes a number of indirect actions leading to therapeutic benefits, such as activating TRPV1 receptors that regulate pain, body temperature, and inflammation.

Does CBD Oil Lower Blood Pressure?

While Park told us that high blood pressure can be caused by a number of factors, CBD oil appears to lower increases in blood pressure caused by stress and anxiety.

She explained that when emotional or physical stress is high, our bodies release a hormone called cortisol. High levels of cortisol can raise blood pressure.

“CBD lowers blood pressure by reducing cortisol levels and dilating blood vessels, allowing more blood flow and leading to lower blood pressure,” Park said.

Park pointed to a study of 11 participants that showed CBD oil may lower the levels of cortisol produced in the body. This study showed that volunteers saw a significant reduction in cortisol production when given 300 mg and 600 mg of CBD compared to the placebo control.

In a famous 2017 randomized crossover study led by British doctor Khalid Jadoon and published in the Journal of Clinical Investigation (JCI), a single dose of 600 mg of CBD oil or a placebo was administered to nine healthy volunteers. The resulting data showed that acute administration of CBD reduced resting blood pressure compared to placebo dosing.

The patients were then given a series of stress tests to increase heart rate. Those who were given 600 mg of CBD had lower stress-induced blood pressure spikes than the control group.

It’s amazing, but it’s true. A single dose of cannabidiol lowered the blood pressure of patients, whether they were resting or under stress.

The sample size of these studies was small and further research is required to establish whether CBD has a role in the treatment of cardiovascular disorders, but the results are promising.

How CBD Can Help With Hypertension

As Park explained, high blood pressure can be caused by many factors. Fortunately, there are several health benefits of CBD that could indirectly help with hypertension.

Anti-Anxiety

Anxiety can lead to rapid heart rate and palpitations, leaving you at risk for high blood pressure and heart disease.

CBD oil has been shown to reduce anxiety in animal studies by the National Institute for Drug Abuse (NIDA). This study demonstrated that symptoms that accompany anxiety, like high blood pressure and rapid heart rate, were improved by use of CBD.

Reduces Inflammation

Inflammation doesn’t only occur in your joints. In fact, research shows that CBD oil can reduce inflammation in the heart and blood vessels in the brain.

Called a “vasorelaxant” by researchers, CBD oil’s anti-inflammatory properties may lower blood pressure by allowing the free flow of blood through your heart, arteries and veins.

Analgesic Properties

According to the National Institutes of Health (NIH), acute pain can lead to high blood pressure. Because CBD acts on the pain receptors in the brain, the pain-relieving properties of CBD could lead to decreased blood pressure.

CBD Improves Sleep

As CBD reduces stress, you may see an increase in your quality of sleep and general wellness.

Sarah Polansky, owner and developer of the CBD brand Prismatic Plants, told Public Goods that “The more you take CBD and help to regulate your adrenals, the less likely you’ll feel fatigued as your body returns to a state of balance rather than constant stress.”

She added, “This means your need for caffeine consumption could decrease and your quality of sleep could improve, which has a waterfall benefit for increasing overall health.”

Choosing CBD Oil for High Blood Pressure

No prescription or documentation is needed for CBD oil. The only exceptions are the marijuana-derived CBD oil sold in dispensaries (in medical marijuana states, you’ll need a patient card to buy it) and a medication called Epidiolex, a CBD medication only available by prescription to patients suffering from some forms of childhood epilepsy.

All of the forms of CBD that you can buy over the counter are not generic products. Their effectiveness depends largely on the quality of the manufacturer producing it, and the type of CBD that’s used.

Many of the cannabidiol products you’ll see in CBD stores or online are of lower quality, since – as with any product – it’s more expensive to produce high-end merchandise and it sells for a higher price, often with lower profit margins for the vendors.

High-quality CBD oil, capsules, topicals, juice for vaping, or edibles will always produce a better result, so it’s best to do a little research to find reputable vendors who create effective products. Look for oil sourced from Colorado or West Coast organic hemp, extracted with high-end methods (like supercritical CO2 extraction), and containing only a small number of natural or organic ingredients required for flavoring or distributing the cannabidiol (the latter is done via MCT coconut carrier oil in high-quality CBD).

Some cannabidiol delivery methods work more slowly than others.

Capsules and edibles, for example, must make their way through the digestion process before the CBD can be released into the blood stream and carried throughout the body. Vaping or administration under the tongue make the cannabidiol available almost immediately, since it’s absorbed quickly by the sublingual glands or tissues in the lungs. And topical CBD usually doesn’t even make it into the bloodstream, since it’s blocked by the epidermis.

When shopping for CBD oil, you’ll find there are three different types to choose from.

  • Full-spectrum CBD is the most effective. It contains all of hemp’s natural terpenes and flavonoids, as well as all of the cannabinoids in the plant – including the small amount of THC we’ve mentioned. They all work together in the so-called “entourage effect” that boosts CBD’s performance.
  • Broad-spectrum CBD provides a slightly lower entourage effect, because the THC content has been removed from the cannabidiol before it’s processed and sold.
  • CBD isolate goes a step further. All of the components of hemp except cannabidiol are removed, leaving only pure CBD in the final products.

Some people believe that pure cannabidiol does the most good, but in reality, there’s only one reason to avoid CBD that contains THC: it eliminates any chance of turning up dirty on a drug test for marijuana. In reality, very few full-spectrum CBD users ever test positive, but some people’s minds are set at ease by knowing there’s no THC in their body.

What’s The Best CBD Dosage for High Blood Pressure?

Because the FDA has not approved over-the-counter CBD products, there is no official recommendation for a dose of CBD. The right dose depends on your weight, genetics, sex and medical history. More studies need to be conducted with human subjects to get an accurate dosage.

Many CBD oils come in dropperful (1 ml) doses of 10 mg/ml. Cannabidiol affects different people, particularly based on the weight, metabolism and body type. However, Park said the effective therapeutic dose is usually in the range of 20 mg to 300 mg, or 2 to 30 dropperfuls.

In a 2018 study, researchers found that a dose of 300 mg was most effective for reducing anxiety in a simulated public speaking trial. Participants who took 150 mg or 600 mg did not receive the same benefit.

Meanwhile, in the previously-mentioned study of nine healthy volunteers, blood pressure was effectively lowered with a single dose of 600 mg.

The best way to determine how effective a dose of CBD will be for you is to start small and frequently check your blood pressure using an electronic cuff. Write down the dose you took and the time you took it, as well as your blood pressure reading. Over time, you should be able to obtain a clearer picture of what dose will help you achieve low blood pressure.

Park noted that, “If CBD works for you, without the use of other medications, I would say it is a great and safe alternative.” CBD may not be a replacement for exercise and a healthy diet, but it is nice to know you might be able to lower your blood pressure with a few drops of oil under the tongue.

What Is High Blood Pressure (aka Hypertension)?

Hypertension, also known as high blood pressure is a silent disease that means the force of blood flow in the blood vessels of your body is too high. It’s sometimes called the “silent killer” [1] because many people do not have symptoms of high blood pressure but it can also lead to major heart disease or cause health issues such as heart attacks, stroke, and even kidney problems.

A normal blood pressure [6] is usually less than 120 over 80 ( [7] is defined as high blood pressure without a known direct cause, typically due to a variety of factors such as obesity, age, diabetes, stress, non-active lifestyle, and many more.

Secondary hypertension [8] is caused by another disease or medication. Possible conditions that cause secondary hypertension include kidney problems, hormonal diseases, Cushing’s syndrome, thyroid issues, sleep apnea. Medication causes include birth control medications, nonsteroidal antiinflammatory drugs (NSAIDs), steroids, and illicit drugs (cocaine, amphetamines, etc).

CBD Effects on Blood Pressure

The effects of CBD on blood pressure has not been fully studied. There are some animal studies and a few small studies in humans available that describe the effects of CBD on the vascular system, however the majority of studies are with other cannabinoids such as tetrahydrocannabinol.

The mechanism by which CBD relaxes could lower blood pressure is by opening blood vessels. This mechanism may possibly be mediated by the endocannabinoid system (ECS). The idea is that CBD interacts with CB1 and CB2 receptors indirectly, which triggers the relaxation of blood vessels.

In one animal study [3] , cannabidiol or CBD acted as a weak or partial agonist on PPARγ receptors. This interaction caused vasorelaxation or widening of the aorta (a heart artery) which could lead to lower possible lower blood blood pressure.

The actual effects of CBD oil on hypertension is not known. In a review of studies [9] , it was suggested that CBD does not impact blood pressure or heart rate. However, one small study showed that a single dose of 600 mg CBD lessened blood flow and lowered systolic blood pressure in healthy people but it also increased heart rate.

In other research [3] , data showed that taking CBD may have beneficial effects on other heart-related problems. For example, one health issue that CBD has shown some effects in is improving heart function. In animal studies, a single dose of cannabidiol resulted in better heart function in rats with diabetes. Other studies showed smaller clots and anti-inflammatory effects in animals that had heart attacks or strokes.

Research on taking CBD oil suggests there may be some potential value for people with hypertension with at least one other heart related problem, but in managing hypertension patients to lower blood pressure only, more studies are needed.

Does CBD oil help with blood pressure?

Based on current research, there is not enough data to say that using CBD oil for high blood pressure is effective. The data is conflicting, especially in human subjects. Some studies report a change in blood pressure readings while other reports no effect on blood pressure after a single dose of CBD.

If you plan to take CBD oil to treat your high blood pressure, you should talk with your doctor first. If your condition is serious enough, you may need to take medications. However, certain medications may carry unwanted side effects. Currently, the American Heart Association [10] recommends diet and exercise as the natural approach for managing hypertension and heart disease.

How does marijuana affect blood pressure?

Marijuana contains both CBD and higher concentrations of THC. In studies, this psychoactive ingredient has shown similar cannabinoid properties to CBD in causing vasorelaxation. However, the evidence is not clear on whether THC helps lower blood pressure.

One study [11] reported that THC increased heart rate but did not significantly change blood pressure in healthy patients. In fact, a long term study [12] reported that hypertension was more common in chronic majrijuana users than those who had never used marijuana before.

CBD Dosage For High Blood Pressure

Since there is a limited number of studies for using CBD oil for hypertension and it has not been approved for this disease, the dose of CBD to treat hypertension is not known.

CBD is one of one of at least 120 identified plant compounds, known generally as cannabinoids, which exist in the hemp plant. It is non-psychoactive, so it won’t get you “high” like THC does. Instead, it has shown a variety of health benefits without causing negative effects in most.

CBD works by interacting with receptors in the body’s Endocannabinoid System (ECS) to help enhance its responses to factors such as stress, pain, inflammation, and fatigue. A few potential benefits of CBD include:

Does CBD make you sleepy during the day?

No research has shown that that CBD makes you sleepy during the day. CBD’s ability to support feelings of calm can lead to improved focus and well being, whether you’re gearing up for a big day at work or preparing for athletic training or competition.

Studies (Blessing et al, 2015; Berger et al, 2009) show that CBD’s anxiety-reducing properties make it a useful tool to manage stress levels, boost focus, and improve mental clarity, all without experiencing drowsiness or lethargy. CBD also supports increased serotonin levels in the brain and can help decrease levels of cortisol, a natural byproduct of stress that can have harmful effects on the body.

CBD vs THC for Sleep

Some cannabis users depend on THC as a sleep aid, however, evidence suggests that CBD has definite advantages over THC (and other sleep aids) when it comes to helping you get a good night’s rest. CBD does not have intoxicating properties like THC, so it won’t cause any negative effects like excessive sedation, drowsiness or feelings of fatigue.

Research studies (Iffland & Grotenherman 2015) have shown that CBD is safe to use for sleep, with no major side effects.

THC can also have other negative effects on sleep cycles as well. According to a 2008 study (Schierenbeck et al, 2008) ingesting marijuana strains with higher levels of THC typically reduces the amount of REM sleep you get. This is key because REM sleep is extremely important for healthy cognitive and immune functioning, and ultimately using THC as a sleep aid could impair your sleep quality over the long term.

Can CBD help with sleeping disorders?

For many, trouble sleeping goes beyond difficulties letting go of the day and relaxing or getting sustained deep and restful sleep. Many suffer from more severe sleep disorders like insomnia, which can have a significant impact on their quality of life. In many cases people struggling with sleep disorders don’t want to resort to medication or intoxicants, leaving them to wonder: can CBD help with sleeping disorders and other serious sleep issues?

In addition to supporting better sleep in general, CBD has shown to be a great option for many people with sleep disorders. Because CBD interacts directly with the endocannabinoid system (responsible for maintaining homeostasis, or balance, within the body), it can help regulate sleep patterns and support the body’s natural circadian rhythms.

How does CBD make you feel?

Overall, your response to CBD will depend largely on factors that are specific to you. This includes your body type, weight, gender, and metabolism. Additionally, the effects of CBD can be influenced by other variables including how you consume CBD (such as ingesting oil or applying a topical to your skin) as well as existing medications or supplements you may be taking.

Another important factor to consider is the type of CBD you’re using. CBD comes in three primary types: full-spectrum, broad-spectrum, and isolate. Full-spectrum contains over 120 of naturally-occurring plant compounds found in the hemp plant. Research shows that full-spectrum CBD can offer the maximum potential of benefits because all of the compounds from the plant interact together, referred to as the “entourage effect”.

Other types of CBD include broad spectrum and CBD isolate. Broad-spectrum contains most of the other cannabinoids and compounds within the plant, with the exception of THC, which is removed after the initial extraction.

CBD isolate is the most simple form of CBD and results from the removal of all of the plant compounds found in hemp except for just CBD. While some people prefer these forms of CBD because they do not include THC, they’re commonly seen as less effective than full-spectrum CBD because they do not benefit fully from the “entourage effect” mentioned earlier.

With this in mind, some of the ways CBD can affect your body and make you feel include:

It’s also important to know that, per a study published in the Brazilian Journal of Psychiatry, different doses of CBD may affect you in different ways. Lower doses can cause feelings of focus and alertness while higher doses may be relaxing.

Additionally, a 2017 study showed that CBD can have anxiolytic effects, meaning that it can reduce anxiety and be calming. When this potential for reducing anxiety and enhancing calm is combined with CBD’s potential to help muscle relaxation, many experience feelings of relaxation in both the mind and body.

A good night’s sleep has incontestable benefits for general health and wellbeing. For 30% of the general population, however, sinking into an effortless slumber doesn’t come easily, according to a national poll by the Sleep Foundation. To make matters worse, sleeping pills and medications commonly used to induce sleep are often accompanied by side effects.

One possible alternative to these medications is cannabidiol (CBD), a non-intoxicating cannabis compound. It is currently trending as a sleep aid as many are discovering that it promotes drowsiness by removing obstacles to sleep, such as anxiety. But are there scientific grounds to believe that CBD can actually support and bolster more healthful sleep? Weedmaps spoke with four experts to find out.

What is CBD and how does it work?

While we have some understanding of how CBD interacts with the body, there is still much to learn.

“CBD itself doesn’t do a lot of heavy lifting when it comes to binding to CB1 and CB2 receptors but instead promotes the binding of the endocannabinoids already in our systems,” Drew Ford, Chief Science Officer at Kase Manufacturing, a cannabis extraction facility, told Weedmaps. “It ensures they bind to the receptors that they’re supposed to go to.”

Endocannabinoid receptors affect the entire body. According to Dr. Thinh Vo, Director of Quality and Compliance at Koi CBD, cannabidiol indirectly has an impact on receptors that send information between “the cells in the nervous, immune, and circulatory systems to regulate biological processes.”

Evidence from a study published in Translational Psychiatry also suggests that CBD inhibits the uptake of anandamide, which is an endocannabinoid that is often referred to as the “bliss molecule.” Anandamide binds to CB1 receptors in the body’s endocannabinoid system, just like CBD. When CBD occupies those receptors instead, anandamide’s pleasant effects may last longer.

How does CBD make you feel?

When it comes to how CBD products will make you feel, the answer will depend largely on individual-specific factors.

“Each person’s reactions to CBD are unique,” Vo told Weedmaps News. “Reactions to CBD are also affected by other variables such as delivery method, whether the person is taking existing medications/supplements, and whether the product is an isolate or a spectrum oil.”

Vo points out that terpenes present in CBD oil also influence the individual’s response. “We know that terpenes play an essential role in determining the strain and influencing a sedative effect, energetic effect, or combination of both,” he explained.

Per a study published in the Brazilian Journal of Psychiatry, when administered at different doses, CBD may provoke distinctive responses. Low doses may cause someone to feel energized and alert, while higher doses may be relaxing and encourage drowsiness. CBD is frequently anecdotally reported to alleviate anxiety.

“CBD is an anxiolytic, which means that it reduces anxiety and is calming,” explains Dr. Elaine Burns, a naturopathic doctor who is CEO and founder of Dr. Burns’ ReLeaf. “In addition, it helps to relax the muscles. These two properties both contribute to a feeling of relaxation in the mind and body.”

Does CBD oil make you tired?

As to whether CBD oil can cause tiredness, expert opinions appear to be mixed. “There is no true clinical evidence to support CBD as a sleep aid. CBD oil itself should not make a person drowsy,” Ford said.

That being said, Ford also acknowledges that CBD may diminish the anxiety that can inhibit sleep and “could be effective as a sleep aid for people who need to calm down and relax their mind.”

Dr. Patricia Frye, a board-certified cannabis clinician and Chief Medical Officer at HelloMD, pointed out that there is evidence that high doses of CBD can modulate adenosine pathways in the brain. “Adenosine is the substance that accumulates during the day and deactivates the sensory neurons in the area of the brain that keeps us awake.”

CBD may also trigger tiredness or a sleep response through its reported effects on the 5-HT1a serotonin receptors, as observed in a study published in the medical journal Pain. “When binding to the 5-HT1a receptors, CBD essentially blocks those receptors from other agonists binding to them,” Ford explained. “Depending on the individual’s body chemistry, when CBD binds to these receptors it can essentially block the anxiety or depression-causing molecules, leading to immediate relief.” As a result, some individuals may feel a sensation of sleepiness.

CBD vs. THC for sleep

THC, the cannabis plant’s most abundant and intoxicating cannabinoid, is reputed to induce sleepiness. Ford believes any feelings of drowsiness associated with CBD oil can most likely be attributed to THC. “If CBD oil is making you feel drowsy, it’s probably due to a fraction of THC being left in the product,” he said.

THC isn’t necessarily more effective than CBD as a sleep aid. An individual’s body chemistry affects how he or she responds to THC, and for some, it may be counterproductive if they’re looking for deep slumber. Ford explained that while the “psychoactivity of THC” can lead to drowsiness, it can also cause the mind to race, ultimately concluding that “it really depends on what symptoms you are trying to overcome and what works best for your own body.”

Burns agrees, adding that THC can also cause anxiety and restlessness at doses higher than 10 milligrams. “Because of this, I would say that CBD is a better sleep aid for most people; however, dosing less than 10 milligrams of THC along with 20 milligrams or more of CBD could be a great combination.”

CBN, the cannabinoid into which THC transforms when exposed to heat and light, may have more sedative effects. One analysis by Steep Hill Labs found that five milligrams of CBN was as effective as a 10-milligram dose of diazepam, a member of the “benzo” family used to treat muscle spasms, seizures, and anxiety. Thus, it’s likely that consuming older cannabis will have more sedative, sleep-inducing effects than fresher flower with less CBN present.

What effect does CBD oil have on sleep disorders?

Although more studies on CBD and sleep disorders need to be conducted, Vo pointed to the U.S. National Institutes of Health’s National Library of Medicine, which returns more than 100 results for a search of CBD and sleep. The articles include studies and reviews of previous research, mostly conducted on animal models, which may overlap. A 2019 review of the use of CBD and THC for sleep indicates that cannabinoids may improve sleep quality, decrease sleep disturbances, and reduce the time it takes to fall asleep.

Many of the studies reviewing CBD, however, examined sleep as a secondary outcome in the context of another illness. Frye highlighted a 2019 study published in Frontiers in Pharmacology that investigated the use of CBD oil for children with autism spectrum disorder to treat related conditions such as sleep disturbances. “Patients with autism typically have sleep disturbances,” she explained. “The study showed that CBD improved sleep in 71.4% of patients.”

What are the other potential benefits of CBD?

As CBD interacts with the nervous, immune, and circulatory systems, it may also offer benefits for a gamut of conditions. An in-vitro study published in the European Journal of Pain suggests that CBD reduced evidence of pain and inflammation behaviors in rats, while another study published in Ingenta Connect found that CBD exhibited anti-anxiety and anti-depression effects in animal models. Too, CBD shows promise in reducing epilepsy-induced seizures and some types of muscle spasms, as shown in this in-vivo study published in The Lancet Neurology and this pilot patient study published in the International Journal of Neuroscience.

Per an in-vitro study published in the British Journal of Clinical Pharmacology, there is also evidence that CBD may potentially improve heart health and, as seen in this scientific review published by CNS Neuroscience & Therapeutics, may offer protective benefits for neurodegenerative disorders such as Parkinson’s disease.

Bottom line

There is some evidence that CBD may reduce anxiety and promote feelings of calm and relaxation, which could lead to better sleep in some people.

However, there is presently little clinical research on human subjects specifically investigating the effects of CBD on sleep disorders. Possibly, future studies will enhance our understanding of CBD, its mechanisms, and its role in sleep regulation.

Hemp for skin health?

CBD oil may offer a spectrum of health benefits, including the treatment of skin disorders, but experts say claims are more anecdotal than scientific.

Marketing for anything with hemp is in high gear, fueled by Congress’s passage in December 2018 of the Agricultural Improvement Act, or farm bill, which legalizes production of hemp in all 50 states.

Hemp, according to a Washington Post article on the $867 billion farm bill, is a form of cannabis with lower THC levels than marijuana. The hemp industry could grow to $20 billion by 2022, according to the article.

Companies are touting CBD oil, a hemp-derived cannabidiol (CBD), for a spectrum of health benefits including the treatment of skin disorders. But the claims are more anecdotal than scientific. It’s hard to find published studies proving CBD is safe and effective. Still dermatologists and others think there’s something to this so-called remedy.

“It’s true, CBD has gone mainstream and is now frequently referred to as a ‘cure-all’ by scientists, doctors and users alike – all because of numerous health challenges that are showing very positive improvements,” says Tina Alster, M.D., clinical professor of dermatology at Georgetown University Medical Center in Washington, DC.

As a result of the farm bill that legalizes CBD, a non-psychoactive (no “high” or intoxicating effect) naturally-occurring compound found in the cannabis plant, each state is responsible for crafting respective legislation to manage the production and sale of CBD within its borders, says Dr. Alster.

CBD for Health Conditions

According to Dr. Alster, some believe that CBD may have a positive impact on a variety of health concerns and conditions including chronic pain, joint Inflammation, anxiety, insomnia, headaches, memory, nausea, neurological disorders, skin disorders and more. The most scientific evidence for using CBD, however, is in the treatment of some childhood epilepsy syndromes. Studies also suggest that CBD may help with sleep and pain, author Peter Grinspoon, M.D., writes in an August 24, 2018, Harvard Health blog.

CBD for Skin Health

CBD oil has an anti-inflammatory property, which can benefit the skin, and it can also reduce oil production, provide moisture and relieve pain and itching, according to Dr. Alster.

“Topical CBD is safe and works effectively for all skin types. The products are easy to administer. Sufferers of serious medical skin conditions and those who are seeking innovative skincare options can benefit from topical CBD use,” Dr. Alster says. “Anti-inflammatory properties associated with CBD are beneficial in treating such dermatologic conditions as acne, psoriasis and eczema due to reduction of dryness, irritation and redness. CBD-containing creams, oils, gels and serums not only moisturize and soothe the skin but are also showing encouraging results in relieving pain caused by certain skin disorders.”

CBD has shown that it exerts antioxidant activity. This could position CBD oil as a treatment that repairs skin from free radicals, which may help to smooth wrinkles and reduce breakouts and blemishes, according to Dr. Alster.

“In addition, CBD-containing products are rich in omega-3 and omega-6 fatty acids which improve overall skin appearance and provide a more youthful glow,” she says.

Topical CBD is considered safe and has no known adverse side effects, according to Dr. Alster.

Dr. Grinspoon writes in his blog that cannabidiol use can result in nausea, fatigue and irritability.

“CBD can increase the level in your blood of the blood thinner coumadin, and it can raise levels of certain other medications in your blood by the exact same mechanism that grapefruit juice does. A significant safety concern with CBD is that it is primarily marketed and sold as a supplement, not a medication. Currently, the FDA does not regulate the safety and purity of dietary supplements,” explains Dr. Grinspoon.

CBD is being tested in numerous laboratories around the world for its health-enhancing properties and its effects on a plethora of diseases and conditions, according to Dr. Alster.

“The CBD skincare industry is still very young, so further research and experimentation is needed,” she says.

This Is What Happens When You Mix Alcohol and CBD

With CBD rising in popularity, it seems people are mixing it with everything, alcohol included. Los Angeles’ bar scene is spilling over with CBD cocktail offerings, and breweries are selling CBD-infused beer. But is mixing CBD and alcohol actually a good idea?

For those who don’t know, cannabidiol [CBD] is a compound in weed with relaxant effects, but it’s not psychoactive in the way that THC is, so it won’t get you high. It’s sold as oil, in edibles, capsules, vape juice, and, apparently, alcohol.

Even if you’re not slapping the two together in a drink, CBD and alcohol can interact if you take them within four to eight hours of each other, says James Giordano, professor of neurology and biochemistry at Georgetown University Medical Center. This means that if you have a drink with dinner then take CBD dab before bed, the CBD could have a stronger effect than it would without the alcohol.

Since alcohol and CBD both relax you and lower your inhibitions, these effects could be especially strong and long-lasting when you mix the two substances. “On CBD, you’re very chill, very lighthearted, mellow. The alcohol will make that more intense,” Giordano says. “For some people, it makes them very, very sedated.” For this reason, he doesn’t recommend the combination.

“Like anything else, as doses increase of either or both, you get yourself more into a problem,” he explains. “The more you drink, the more CBD you’re taking, you get a potentiated effect that’s greater than the effect of either alone. The level of intoxication is going to be greater: greater loss of control, inhibition, motor coordination, and that becomes problematic.”

The effect this combination will have on you depends on what kind of drunk you are, though. “If you’re a happy drunk, then CBD could make you a happier drunk,” Giordano says. “If you’re an angry or violent drunk, the CBD may certainly disinhibit some of that.”

But there could actually be benefits to taking CBD with alcohol, suggests Soyona Rafatja, a New York-based functional and integrative family medicine physician. One study in the journal Psychopharmacology found that people who had alcohol and a CBD capsule had lower blood alcohol levels than those who had alcohol alone, though they experienced the same impairments in cognition and motor coordination. Another study in Pharmacology Biochemistry and Behavior found that rodents experienced less alcohol-induced neurodegeneration if they received CBD through a topical gel while the alcohol was administered.

More research from Free Radical Biology & Medicine showed that rodents that ingested CBD 30 minutes before ingesting alcohol were less likely to experience alcohol-induced oxidative damage in the liver than those that didn’t have the CBD. While they’re just animal studies, experts think they’re quite telling. “Alcohol decreases autophagy [degradation of damaged cells] in the liver, causing fat to accumulate in the liver and therefore cause fatty liver, inflammation, and hepatitis,” Rafatjah explains. CBD does the opposite, spurring damaged cells to degenerate, which can counteract alcohol’s effects.

Jordan Tishler, president of the medical cannabis practice InhaleMD and the Association of Cannabis Specialists, on the other hand, says there isn’t enough research to prove any interaction between alcohol and CBD. He’s more concerned about people mixing alcohol with THC—this, he says, increases THC levels in the blood eightfold.

So, the jury’s still out on the effects of combining alcohol and CBD, and experts can’t even seem to agree. If you’re going to take CBD and alcohol together, Giordano recommends at least keeping the doses low and trying both on their own first so you know how you react to them. “People who don’t drink or do CBD regularly, if they drink and do CBD together, good luck—that’s really going to be unpredictable,” he says. “If there’s any prediction at all, that prediction is, that person’s going to be pretty stoned.”

Hemp producers may not extract the CBD themselves, unless they also have a cannabis processing or research licence.

Importing and exporting industrial hemp

The Industrial Hemp Regulations authorize importing and exporting industrial hemp seed or grain, but not the flowering heads, branches or leaves.

The flowering heads, branches and leaves may only be imported or exported by a licence holder under the Cannabis Regulations:

  • with a permit issued under those regulations
  • for legitimate medical and scientific purposes

To import or export the industrial hemp seeds or grain, you must:

The difference between cannabis oil and hemp-seed oil

Cannabis oil is 1 of the 5 classes of cannabis that may currently be legally sold in Canada by provincially and territorially-authorized retailers:

  • cannabis oil
  • fresh cannabis
  • dried cannabis
  • cannabis seeds
  • cannabis plants

Cannabis oil is a combination of:

  • cannabis:
    • usually in the form of a THC and/or CBD-rich extract from the leaves and flowering heads of the cannabis plant, which may include plants classified as industrial hemp
  • a vegetable-based or plant-based oil such as:
    • olive
    • canola
    • grape seed
    • hemp-seed oil

Hemp-seed oil is oil made from pressing the grain of hemp plants. It is processed like other oil seeds, such as canola. In order for hemp-seed oil to be exempt from the Cannabis Act, it can’t contain more than 10 parts per million of THC.

For hemp-seed oil to be exempted from the Cannabis Act, no phytocannabinoid including THC and CBD may be added or concentrated by processing.

Hemp-seed oil is marketed in Canada in:

  • food
  • cosmetics
  • natural health products
  • veterinary health products

CBD and prescription drugs

All phytocannabinoids, with several exceptions, are listed on the Prescription Drug List. If you wish to manufacture and sell a health product containing CBD that makes a health claim, you require approval for the product as a prescription drug under the Food and Drug Regulations.

CBD in natural health products, veterinary health products and cosmetics

Only limited parts of cannabis or hemp plants may be used in a:

  • natural health product (NHPs)
    • under the Natural Health Product Regulations
  • veterinary health product (VHPs)
    • under the Food and Drug Regulations

NHPs and VHPs may only contain parts of the cannabis and hemp plants that are not considered cannabis under the Cannabis Act or that are excluded from the application of the Act. This includes things such as:

  • non-viable seeds
  • hemp-seed derivatives that are compliant with the Industrial Hemp Regulations
  • mature stalks that do not include any leaves, flowers, seeds or branches and fibre from such stalks are also excluded from the Cannabis Act, but they may not be used in veterinary health products.

Deliberately adding phytocannabinoids to such products is not permitted.

These same restrictions also apply to cosmetics, which may only contain hemp derivatives.

CBD in human food or pet food

Edible cannabis will not be permitted for sale until the Regulations Amending the Cannabis Regulations (New Classes of Cannabis) come into force on October 17, 2019.
These regulations set out strict controls to reduce the:

  • appeal of such products to youth;
  • risk of accidental consumption, especially of edible cannabis, including by youth;
  • risk of overconsumption associated with edible cannabis because of the delay in experiencing the effects of cannabis when it is ingested rather than inhaled; and
  • risk of foodborne illness associated with the production and consumption of edible cannabis.

Edible cannabis will only be available for human consumption.

In the period between 1930 – 1940, cannabis convictions increased. Through the following years, cannabis was more and more equated with marijuana, and its psychoactive effects, which ultimately affected hemp’s legal status.

Marijuana became popular in Canada in the 60s with the rise of the counterculture. Ten years later, advocates made efforts to legalize marijuana.

In 1998, the Canadian government allowed cultivation and processing of industrial hemp under very restrictive rules.

In 2003 and 2004, two bills on the decriminalization of recreational marijuana failed. In 2006, penalties increased, and the maximum sentence on cannabis production doubled from 7 to 14 years.

Today, under the Cannabis Act, cannabis — regardless of its THC content — is completely legal in Canada. The country allows the cultivation of both marijuana and industrial hemp.

Under the Cannabis Act, both marijuana and industrial hemp are completely legal in Canada. However, only cannabis licensed processors and retailers can extract, produce, and sell CBD.

For consumers, it’s easy to order CBD oils if you live in Canada. The hard part is for the people and companies selling CBD oil.

Canada has very strict regulations about who can sell cannabis products. Everything from the storage, labeling, advertising, and pricing are tightly controlled by the Canadian government.

Anybody that wants to sell CBD oils in Canada needs to go through a complicated application process that can take several months. The whole process costs a fortune and leaves a lot of startup founders pulling their hair out.

Canadian Law: What is The Cannabis Act?

During his campaign in 2015, Canada’s Prime Minister Justin Trudeau promised to legalize recreational marijuana. In October 2018, the Canadian Cannabis Act came into effect, amending the Controlled Drugs and Substances Act, and the Criminal Code.

Before the Cannabis Act, CBD was strictly regulated under the Controlled Drugs and Substances Act and was illegal to produce it or sell unless it was authorized for medical or scientific purposes.

The Cannabis Act includes several regulations on the cannabis plant — both marijuana and hemp.

Following its rules, you must be at least 19 (18 in Alberta and Quebec) years of age to purchase cannabis products, and you’re limited to 30 grams of dried cannabis in public at a time.

30 grams is pretty generous. This works out to just over an ounce, which is plenty for most cannabis users in a given day, but not so much that it’s even worth selling on the black market.

The Canadian government employed strict penalties if users don’t abide by these rules. Possession over the 30 gram limit could lead to 5 years in prison.

It’s illegal to transport any cannabis products across the US-Canada border. This is true even in cases where the border-state considers CBD completely legal. How is Industrial Hemp Regulated Under the Cannabis Act?

The Cannabis Act includes a specific regulation on hemp, known as the Industrial Hemp Regulations Program (IHR). The Industrial Hemp Regulations Program defines hemp as a cannabis plant and plant parts with a THC content of 0.3% or less in the leaves and flowering heads [1].

Under this program, Canadian farmers can grow low-THC cannabis — which we’ll refer to as industrial hemp — under government-regulated conditions. To cultivate, process, and sell industrial hemp, Canadian farmers must obtain a federal license.

The IHR allows the procession and sale of industrial hemp derivatives such as hemp seed oil, hemp flour, and hemp seeds.

Under the IHR, industrial hemp does not include derivatives obtained from the flowering parts of the leaves.

Therefore, farmers who want to extract derivatives from industrial hemp (including CBD), must obtain a cannabis processing license.

The cannabis processing license authorizes the grower to cultivate hemp for the parts that have CBD and process them for CBD products.

Without this license, the hemp grower can still cultivate the plant for CBD-containing parts but only sell them to a licensed cannabis processor.

The truth is that the optimal dose of CBD is different for everybody.

It’s common for two people with identical weight to respond very differently to the same dose of CBD. One person may find the ideal dose for them is 30 mg of CBD, while the other responds better to just 10 mg.

The ideal dose of CBD for you depends on a variety of factors, including:
