The federal government considers marijuana a Schedule I drug under the Controlled Substances Act, making it illegal for interstate commerce, even as dozens of states legalize it for adult use. Industrial hemp, on the other hand, was recently removed from the Controlled Substances Act altogether, opening the way for its cultivation and harvest in the U.S. for the first time since 1937.

Full-spectrum CBD vs. CBD isolate

If you’ve done any research into the CBD market already, you’ve likely encountered the terms “full-spectrum” or “isolate.” Depending on the extraction methods used, the CBD oil obtained from the plant might contain other cannabinoids and compounds found in the source plant. This is what is known as full-spectrum CBD. Understand your legal obligations

Just because the 2018 Farm Bill federally legalized industrial hemp and, by extension, hemp extract, like CBD oils, doesn’t mean there aren’t significant regulatory considerations surrounding the industrial hemp industry.В

The 2018 Farm Bill essentially removed CBD from the federal Controlled Substances Act and the oversight of the Drug Enforcement Agency. Instead, it placed governance of the hemp industry and CBD oil in the hands of the FDA.В

Currently, the FDA is still devising regulations, leaving the CBD industry in a sort of gray area. So far, the federal agency has signaled that marketing CBD as having health benefits will not be tolerated. It has also initiated a crackdown against CBD-infused foods and beverages in some instances.В

Further complicating the regulatory landscape is the 2017 approval of the CBD-based pharmaceutical Epidolex, an epilepsy medication that was approved by the FDA. Since CBD is a main ingredient in an FDA-approved drug, using it in food products without FDA approval could be illegal. Clearer guidance is sorely needed for CBD businesses to operate in compliance with federal regulations.В

“I think the FDA does have to step in, and they will,” said Slovik. “I expect a lot of changes to labels; we’re seeing a lot of businesses out there now using the term ‘hemp extract’ instead of CBD, or they’re not thinking of health benefits so much. Many companies are doing different things, but no one really knows [what the regulations will be] until it happens.”В

Understanding your legal obligations and playing it safe is key in a highly scrutinized industry. While CBD businesses everywhere await clearer regulatory guidance, it is important not to craft your marketing strategy around the supposed benefits of CBD. It’s also important to stay apprised of new developments as the FDA moves forward on crafting new regulations.

Market and sell your products

Marketing and selling CBD products is tricky. While the passage of the 2018 Farm Bill liberalized the industry a little bit (CVS and Walgreen’s now carry CBD products, for example), it is still difficult to sell CBD products on major online platforms like Amazon or eBay. Likewise, social media advertising is virtually nonexistent; paid ads for CBD products risk account suspensions or bans. All your growth must be driven through organic content that falls under the guidelines of each platform.В

“In today’s day and age, if someone is looking to sell a product, the normal avenues are Amazon, eBay, Alibaba or paid ads on social media,” Slovik said. “In this industry, it’s way, way, way different. You can’t do any of those things.”В

To successfully advertise and sell your CBD products, you will have to be creative. Establishing your own e-commerce store or carrying your products in a brick-and-mortar location is a must. Marketing your product with an organic search strategy and customer loyalty programs is always safer than engaging in paid advertising. And, of course, every market is a bit different, so do your research and understand your local and state laws.

How to gain a competitive advantage

The key to gaining a competitive advantage with staying power in the CBD industry is to develop a high-quality product that will withstand the coming scrutiny of both regulators and educated consumers. If you want to differentiate yourself from other CBD businesses, it’s key to provide third-party lab testing results to validate the quality of your product, Slovik said.

“We want to be more transparent by putting QR codes on all our bottles so anyone in the store can use their phone to get lab results right then and there,” Slovik said.В

In addition, Slovik said pursuing certifications like USDA organic, Good Manufacturing Practices and FDA facility registrations are important moves to instill confidence in consumers about the quality of the product they are buying.В

Overall, Slovik said, the formula for success is simple, even if the process is complicated.

“I would recommend double-, triple-checking everything. Know there will be changes. Research as much as you can, and recognize what the future opportunities are by thinking outside the box,” he said.

Key challenges facing CBD businesses

The CBD and cannabis industry faces unique challenges that other industries don’t. Most of these challenges relate to the regulatory environment and, as federal agencies like the FDA detail specific rules and guidelines, things should stabilize. For now, though, if you want to start a CBD business, you should be aware of these major considerations:В

  • Banking: Access to reliable banking services can be complicated due to the fluctuating regulatory landscape. Many banks are hesitant to do business with CBD and cannabis companies, fearing significant risk or burdensome oversight. Frequently, CBD businesses are forced to switch banks or experience the abrupt closure of a merchant account, which can seriously disrupt operations.В
  • Insurance: Finding affordable insurance for a CBD business is another major challenge. Prices remain elevated despite the legalization of industrial hemp, Slovik said, as the industry takes time to catch up to the developments. Education remains a key obstacle.В
  • Payment processing: Similarly, payment processors present high fees and other challenges to CBD businesses. Slovik said Visa recently cut off all CBD businesses, leaving him capable of only accepting MasterCard and Discover for payments.В
  • Access to capital: Banks and other lenders are reluctant to fund CBD companies, viewing the industry as too risky without clear regulatory requirements. So far, the CBD industry has relied on bootstrapping, outside investors or alternative lenders to find the growth capital it needs.В

Each of these challenges will likely be cleared up as more concrete regulation appears, but in the meantime, CBD businesses must remain adaptable and well-informed. The chemical has shown promise in treating numerous health conditions, ranging from epilepsy and other seizure disorders, to neurological conditions like Alzheimer’s disease, to mood disorders such as depression, anxiety, and psychosis, to pain, cancer, and much more.

As research remains ongoing, there is a growing body of evidence pointing to CBD’s potential efficacy in various medical applications.

Why is CBD sometimes illegal?

Even though hemp strains don’t produce enough THC to produce intoxicating effects, all types of cannabis, including hemp, were considered illegal under the 1970 Federal Controlled Substances Act. The law swept all cannabis into the Schedule I category, which defines a substance as having a high potential for abuse, no accepted medical use, and a likelihood for addiction.

The Hemp Farming Act of 2018, which was signed by President Donald Trump on Dec. 20, 2018, legalized industrial hemp cultivation on the federal level and created a pathway to remove some cannabis from Schedule I status by creating a legal distinction between hemp and marijuana. Hemp is classified as cannabis that contains less than .3% THC by weight, while marijuana is cannabis that contains more than .3% THC and is therefore still categorized as Schedule I.

The Farm Bill also granted the US Food and Drug Administration (FDA) the power to regulate CBD’s labeling, therapeutic claims, and its use as a food additive. Despite the passage of the Farm Bill, the FDA has taken the stance that hemp-derived CBD may not be added to food and beverages, nor marketed as dietary supplements. While the FDA has begun a process of reevaluating its stance on such CBD products, it has yet to revise its rules or specifically regulate CBD products, leading to confusion in the market. The FDA has been strict when it comes to health claims and content that could be construed as medical advice about CBD.

The federal legislation places regulations on the production and sale of hemp, including hemp-derived CBD products. The Farm Bill also provides that states may regulate and even prohibit CBD cultivation and commerce. In addition, states may attempt to regulate CBD food, beverage, dietary supplement, and cosmetic products, independently of the FDA finalizing its views on such products.

Florida CBD laws

CBD laws in Florida have undergone several changes in recent years. In 2014, Florida lawmakers approved SB 1030, which legalized low-THC CBD oil for qualifying medical marijuana patients registered in the state program. Florida’s first rudimentary medical marijuana program made it legal for patients with cancer, muscle spasms, seizures, and terminal illness to obtain a doctor’s recommendation to purchase, possess, and consume medical cannabis containing 10% or more of CBD and no more than .8% of THC.

In 2016, voters approved Amendment 2,which significantly expanded the state’s medical marijuana program, but still did not allow for smokable forms of marijuana. After the Florida Supreme Court struck down the ban on smokable marijuana, lawmakers in March 2019 passed SB 182, which was signed by Republican Gov. Ron DeSantis. Today, registered medical marijuana patients have access to medical cannabis products that contain high levels of both THC and CBD.

During this same time period, other more CBD-specific laws in Florida were evolving alongside the medical marijuana program. SB 1020, which was passed by state lawmakers in July 2019, is by far the most important piece of legislation affecting CBD oil in Florida. This law introduced several key changes:

  • In keeping with the 2018 Farm Bill, SB 1020 explicitly legalized hemp, which the law defined as a plant containing less than .3% THC by weight, the same as the federal standard.
  • The law also legalized hemp extracts, defined as any substance derived from legal hemp plants that do not contain other controlled substances and are intended for ingestion.
  • Legalizing CBD specifically, SB 1020 stated that hemp-derived cannabinoids are not controlled substances.

To grow and process hemp and hemp extracts, such as CBD oil, a person or business must apply for a state license. All hemp products must also be tested by a licensed independent laboratory, certifying that the product contains no more than 0.3% THC and does not have any contaminants.

In 1933, a young man named Victor Licata used an ax to murder his parents, two brothers, and sister. He had been previously treated for mental illness, but the police report and press attributed his violent outburst to marijuana cigarettes.

This led the chief of the Tampa Police Department to pledge himself to marijuana prohibition.

Additionally, the local newspapers printed articles stating that marijuana is a poisonous, mind-wrecking substance that should have never been allowed in the United States.

Marijuana was not off to a good start in Florida.

In 1985, a Florida watermelon farmer was found with marijuana plants on his land. The state convicted him and received probation.

5 years later, the federal government prosecuted him and sentenced him to life in prison for the same offense.

Once, it was terrifying to grow or possess marijuana in America.

Currently, possession for under 20 grams of marijuana can land you in prison for 1 year with a fine. Anything over 20 grams can get you up to 5 years in the clink. Your driver’s license may also get suspended even if your crime was unrelated to driving.

Although the laws in Florida still don’t allow recreational marijuana use, it’s possible to receive a medical marijuana license.

Medical Marijuana in Florida

The state made its first steps towards medical marijuana in 2014 when governor Rick Scott passed Senate Bill 1071, which approved a single non-euphoric strain of marijuana (called “Charlotte’s Web”) to be used as a medication for those who have epilepsy.

Charlotte’s Web is low in THC and therefore doesn’t get the user high.

Florida then passed the Florida Amendment 2 (Florida Medical Marijuana Legalization Initiative) in 2014, which would have allowed the use of marijuana for a limited number of medical conditions but it ultimately failed the public vote. Florida requires a supermajority of 60% while Amendment 2 fell just short at 57.62%.

Florida lawmakers reintroduced Amendment 2 in 2016, which succeeded with 71.32% of the votes. Medical marijuana was now available for Floridians in need.

Although the Florida Medical Marijuana Legalization Initiative went into effect in January 2017, there are specific conditions that need to be met to receive medical marijuana.

The use of CBD oil, which has been touted as a cure-all product for ailments ranging from arthritis to anxiety, is a growing trend across the nation, especially in Kentucky. And while some call it a medical miracle, others question whether it’s legal in the state because of its association with marijuana.

CBD oil is made by extracting CBD from the cannabis plant, then diluting it with a carrier oil, such as coconut or hemp seed oil, according to healthline.com. CBD is drawn from the flower of the hemp plant, and both hemp and marijuana are derived from cannabis sativa. It’s that connection to the cannabis plant that leads to a common question about the safety and legality of CBD oil: “Can you get high off CBD oil?”

The answer? In short, no, you can not get high from cannabidiol, more commonly known as CBD. CBD lacks the large amount of THC, or tetrahydrocannabinol, the crystalline compound that is the main active ingredient of cannabis or marijuana.

And while you can’t get high off the products, many do claim it helps lessen pain associated with everything from multiple sclerosis to epilepsy, to skin disorders like psoriasis.

While growing or possessing marijuana is not legal in Kentucky, it is legal to grow hemp, with a license. In fact, hemp crops have been a driver of economic success for the state.

According to Kentucky Agriculture Commissioner Ryan Quarles, hemp brought in $57.75 million in gross product sales last year, up drastically from 2017, which saw $16.7 million in sales.

Some of those sales have been from local chains, like Rainbow Blossom, a series of health food stores in the Louisville area. But as the demand for CBD products rises, you’re more likely to find it on a store shelf where you’d least expect it. Walgreens welcomed CBD products into almost 1,500 stores earlier this year, and CVS also began selling the CBD products in 800 stores.

Soon you might be able to grab a CBD lotion or other beauty product off the shelf during your next Target run. Superstores like Target and Walmart have started “initial discussions” with CBD manufacturers, according to an April article on nypost.com.

The NY Post article also stated the chains, which include supermarkets such as Kroger, “are requesting samples of CBD products, along with lab results and pricing information.”

Now, Kroger announced it will begin selling CBD oil in its stores in 17 states — yes, Kentucky and Indiana are two of them.

“We will not be selling ingestible at this time,” Kroger’s Louisville division spokeswoman Erin Grant told the Cincinnati Enquirer. “We are offering our customers a highly-curated selection of topical products like lotions, oils, balms and creams that are infused with hemp-derived CBD.”

But don’t get too excited yet. Target said the company has no “immediate plans to carry.” Similarly, Walmart said it is “not carrying CBD products right now,” according to a “Today” show report.

What is CBD oil?

Is CBD oil legal in Kentucky?

As long as CBD is derived from industrial hemp, it is legal to own CBD oil under KRS 218A.010.

When the Agriculture Improvement Act of 2018 was signed into federal law, the U.S. Food and Drug Administration allowed for “the production and marketing of hemp” and other derivatives of cannabis with low amounts of THC, defined as less the 0.3%.

This percentage was previously set in the Agriculture Act of 2014, also known as the Farm Bill. The Farm Bill also removed hemp from the controlled substance list.

Hemp vs. weed: Can you get high off CBD oil?

In short, no, you can not get high from CBD, which is drawn from the flower of the hemp plant. Both hemp and marijuana come from the same plant, cannabis sativa. The difference between these lies in the amount of tetrahydrocannabinol (THC) in them.

Yes, but you’ll need a license. The Kentucky Department of Agriculture requires a license be issued to any person growing, handling or processing industrial hemp derived plants, seeds, leaf or floral materials.

Without a license issued by the department, growers could face the same penalties as those who violate policies related to marijuana.

Some of Murphy’s patients also reported more restful sleep and less anxiety following use. However, Murphy said a small number of his patients stopped taking it after experiencing dizziness. Some didn’t experience any relief from their severe pain of migraines.

It is recommended to speak to a doctor before taking any over-the-counter medication or supplement, especially if you have a preexisting condition.

Because CBD oil is fairly new, there haven’t been any confirmed studies on whether it hurts or helps anxiety. Some patients have reported less anxiety or depression after use, including more restful sleep.

Murphy warned that CBD treatment may not be for everyone, including those with heart conditions or those who take blood thinners.

CBD can potentially interact with any pharmaceuticals you’re taking because of its inhibition on cytochrome P450, a family of liver enzymes. According to Project CBD, cytochtome P450 metabolizes the drugs we consume. CBD can temporarily deactivate these enzymes, which would alter how the drugs are consumed.

Hemp is a crop that connects Kentucky’s past with its future. In the 18th century, Kentucky was one of the largest suppliers of hemp in the United States until the 1930s, when both hemp and cannabis were criminalized. Following the 2014 Farm Bill, Kentucky reinstated hemp as a crop and has since developed a robust industrial hemp pilot program.

Non-psychoactive CBD was first legalized in Kentucky in 2014 for eligible patients under SB 124. The bill made no provision for the sale or production of CBD outside medical contexts. In 2017, hemp-derived CBD products with 0.3% THC or less became legal for all consumers in Kentucky.

Kentucky has no medical cannabis program at present. Adult-use cannabis is illegal. The possession of small amounts of cannabis has been decriminalized in Jefferson County and Louisville.

What is CBD?

CBD is a non-intoxicating cannabinoid found in cannabis and the second-most prominent in the plant after THC, which is largely responsible for producing an intoxicating high. CBD can be sourced either from marijuana or hemp plants and has a wide range of potential therapeutic benefits.

To date, researchers have identified a number of potential applications linked to CBD, including anti-inflammatory, analgesic, anti-anxiety, and anti-seizure properties. Further, the chemical has shown promise in treating numerous health conditions, including seizure disorders, mood disorders such as depression, anxiety, and psychosis, chronic pain, and many more.

Most raw cannabis strains on the market today contain small amounts of CBD, especially compared with THC. But since the cannabinoid has gained considerable attention for its wide range of purported therapeutic benefits, more high-CBD strains have recently been cultivated.

Why is CBD sometimes illegal?

All types of cannabis, including hemp strains that don’t produce enough THC to cause intoxication, were considered illegal under the Federal Controlled Substances Act of 1970. The law categorized all cannabis as Schedule 1, which defined the plant as a highly addictive substance with a high potential for abuse and no accepted medical use.

The 2018 Farm Bill re-classified hemp as an agricultural commodity and made its cultivation federally legal. Further, the act removed some forms of cannabis from Schedule 1 status by creating a legal distinction between hemp and marijuana. Hemp is cannabis with less than 0.3% THC, and marijuana refers to cannabis with more than 0.3% THC. This distinction in federal law effectively legalized CBD that is derived from cannabis with less than 0.3% THC, as long as it has been cultivated according to federal and state regulations.

The 2018 Farm Bill legislation does not mean that CBD derived from hemp is universally legal throughout the United States. According to the Farm Bill, the Food and Drug Administration (FDA) has the power to regulate CBD product labeling, including therapeutic claims and the use of CBD as a food additive.

The FDA has declared that even hemp-derived CBD may not legally be added to food and beverages, or marketed as a dietary supplement. Although the organization has begun to re-evaluate some of its stances on legal CBD products, the FDA has not revised its regulations. The agency also has been strict in its position against any labeling that could be perceived as a medical claim about CBD.

In addition to the federal regulation of CBD, the Farm Bill also gave states the option to regulate and prohibit the cultivation and commerce of CBD. States may also regulate CBD in food, beverages, dietary supplements, and cosmetic products independently, even before the FDA finalizes its policies.

Kentucky CBD laws

Kentucky residents may legally purchase and consume hemp-derived CBD products on the provision that the product contains no more than 0.3% THC or other cannabinoids. Hemp-derived CBD cannot be sold in flower form.

In 2014, hemp cultivation was legalized with the passage of the 2014 Farm Bill. In that same year, 2014, Gov. Steve Beshear signed SB 124, a law that allowed eligible patients to access hemp-derived cannabidiol (CBD) products with a physician’s written order. CBD derived from cannabis is illegal in Kentucky for medicinal purposes. Two bills proposing the creation of a medicinal cannabis framework were passed over in 2015.

The 2014 Farm Bill catalyzed the creation of Kentucky’s industrial hemp pilot program, with regulations drafted and overseen by the Kentucky Department of Agriculture (KDA). In 2017, Kentucky lawmakers passed HB 333, which broadly legalized the consumption and retail sale of hemp and hemp-derived CBD products that contain 0.3% THC or less.

In April 2018, Kentucky legislators published HCR35 in 2018 before the Farm Bill was signed into law, urging the FDA to remove hemp from the definition of marijuana and its Schedule 1 classification. When the 2018 Farm Bill passed, Kentucky lawmakers approved HB 197 to align the state’s definition of industrial hemp with that of the federal government.

There is no specific legislation in Kentucky regarding the use of CBD in food or beverages.

Licensing requirements for CBD

The Kentucky Department of Agriculture (KDA) is responsible for the management and oversight of the state’s hemp program. The 2020 growing season will see Kentucky shift from its research pilot program to full commercial hemp production under its USDA approved state hemp plan.

Only license holders registered with the KDA can grow hemp. Home cultivation of hemp without a license, or of cannabis with greater than 0.3% THC content, is illegal. Those interested in applying for a license to grow hemp must supply a criminal background check. To qualify for a license, the applicant must have no felony convictions or drug-related misdemeanors dated within the past ten years.

Kentucky CBD possession limits

The possession of any amount of CBD is legal in Kentucky on the condition that the product contains less than 0.3% THC by weight.

CBD derived from cannabis is illegal, even for medical patients. Possession of up to eight ounces of cannabis can lead to 45 days in prison and a $250 fine, while a subsequent offense of fewer than eight ounces may result in a felony charge, 1 to 5 years in prison, and a maximum $10,000 fine. Cannabis possession of more than eight ounces results in increased imprisonment.

Abstract

Background: Both hempseed oil (HO) and flaxseed oil (FO) contain high amounts of essential fatty acids (FAs); i.e. linoleic acid (LA, 18:2n-6) and alpha-linolenic acid (ALA, 18:3n-3), but almost in opposite ratios. An excessive intake of one essential FA over the other may interfere with the metabolism of the other while the metabolisms of LA and ALA compete for the same enzymes. It is not known whether there is a difference between n-3 and n-6 FA of plant origin in the effects on serum lipid profile.

Aim of the study: To compare the effects of HO and FO on the profile of serum lipids and fasting concentrations of serum total and lipoprotein lipids, plasma glucose and insulin, and haemostatic factors in healthy humans.

Methods: Fourteen healthy volunteers participated in the study. A randomised, double-blind crossover design was used. The volunteers consumed HO and FO (30 ml/day) for 4 weeks each. The periods were separated by a 4-week washout period.

Results: The HO period resulted in higher proportions of both LA and gamma-linolenic acid in serum cholesteryl esters (CE) and triglycerides (TG) as compared with the FO period (P Conclusions: The effects of HO and FO on the profile of serum lipids differed significantly, with only minor effects on concentrations of fasting serum total or lipoprotein lipids, and no significant changes in concentrations of plasma glucose or insulin or in haemostatic factors.

Some people may be apprehensive to try CBD over concerns that it could cause them to fail a drug test. It’s highly unlikely that CBD would show up on most drug screenings, as most tests specifically look for the presence of THC and THC metabolites.   • cause damage to blood vessels

Medical cannabis

This means a cannabis based product used to relieve symptoms.

Some cannabis based products are available on prescription as medicinal cannabis. The following medicines are sometimes prescribed to help relieve symptoms.

Nabilone (Cesamet)

Clinical trials need to be done in large numbers where some patients have the drug and some don’t. Then you can compare how well the treatment works.

Many of the studies done so far have been small and in the laboratory. There have been a few studies involving people with cancer.

Cancer pain

Other research

A drug called dexanabinol which is a man made form of a chemical similar to that found in cannabis has been trialled in a phase 1 trial. This is an early trial that tries to work out whether or not the drug works in humans, what the correct dose is and what the side effects might be. The results are not available yet. Word of caution

Cannabis is a class B drug and illegal in the UK.

There are internet scams where people offer to sell cannabis preparations to people with cancer. There is no knowing what the ingredients are in these products and they could harm your health.

CBD oil (cannabidiol) is everywhere these days. Once available only at novelty or vitamin shops, it’s now also at your local grocery store, pharmacy or even yoga studio.

It comes in many forms: oils that are dropped under the tongue, roll-ons that are applied to the skin and even solutions for vaping. Some producers extract CBD oil and add it into foods to create edible products.

But what is CBD oil exactly, and how does it affect cancer patients? Can it really treat — or even cure — cancer or relieve its symptoms? To separate fact from fiction, we spoke with our Kimberson Tanco, M.D. Here’s what he wants cancer patients to know.

What is CBD oil, and how does it differ from marijuana and hemp?

Marijuana and hemp are both varieties of the cannabis sativa plant. Both contain cannabidiol (CBD) and tetrahydrocannabinol (THC) — the two most-common, known active ingredients.

The main difference is that hemp has far less THC than a typical marijuana plant. And unlike THC, CBD is not a psychoactive agent, so there’s less possibility that it will cause the same mental confusion, drowsiness or hallucinations that often come with THC.

Is there any truth to the claims that CBD oil can cure cancer?

Right now, no. There is no evidence that CBD oil can cure cancer.

What, if anything, can CBD oil do to alleviate the symptoms of cancer or the side effects of cancer treatment?

It’s hard to say if CBD oil can alleviate cancer symptoms or cancer treatment side effects, because the studies are pretty mixed and even fewer are standardized.

There have been reports that cannabinoids like THC and CBD may be helpful for nausea and vomiting and anorexia, as well as neuropathy, anxiety, depression and insomnia. Synthetic cannabinoids like dronabinol have been approved for use with chemotherapy-induced nausea and vomiting, but have not been shown to be superior to conventional anti-nausea medications.

Have any CBD-oil derived products been approved by the U.S. Food and Drug Administration (FDA) to treat cancer, its symptoms, or the side effects caused by its treatment?

Have any products using CBD-oil been approved by the FDA to treat anything?

Yes. Epidiolex. It was originally approved in 2018 for the treatment of two conditions, both related to epilepsy: Lennox-Gastaut syndrome and Dravet syndrome. But aside from Epidiolex, no CBD product has been approved by the FDA for any other medical purpose.

What are the dangers of using CBD oil?

Quality, cleanliness and regulation are the biggest concerns.

All drugs and dietary supplements are regulated by the FDA. But as long as CBD oil is not marketed as a medicine or a dietary supplement, producers can get around that policy. So right now, CBD oil is very unregulated. That means it’s hard to know how much CBD or THC is really in any given product. Certain hemp CBD products have been found to contain significantly less CBD or more THC than advertised.

In terms of purity, THC and CBD are both extracted from hemp and marijuana using essentially similar processes. But trace amounts of THC could still end up in CBD oil. And if the THC is at a high enough concentration, it could produce the psychoactive effects that THC is known for.

Second, if a lab produces both CBD and THC products, there can be cross-contamination — whether it’s through extraction, handling or packaging.

Third, the plant itself may have higher levels of THC than expected. This could be due to its environment, prolonged flowering periods or cross-contamination and pollination between male and female plants, resulting in offspring with higher THC content. This especially affects hemp plants, which should have less than 0.3% THC levels.

Finally, there have been some reports of people getting infections after using CBD and cannabis products. This is especially concerning for immunocompromised patients, who are already susceptible to bacterial and fungal infections.

Studies on a certain CBD manufacturer showed its products were contaminated with a chemical known as 5F-ADB, which mimics THC. 5F-ADB is classified by the U.S. Drug Enforcement Administration as illegal, potentially addictive and with no accepted medical use.

Other sorts of substances have been found in CBD products, too, such as dextromethorphan, which is an ingredient in cough medicines. Heavy metals like lead and arsenic, pesticides and mold have also been found in CBD products.

Does CBD oil have any side effects?

CBD oil can adversely affect liver function. In fact, this is on the warning label for Epidiolex.

And in lab studies, CBD has been shown to inhibit certain enzymes responsible for the metabolism of drugs, such as CYP2D6 and CYP3A4. This can affect how drugs work and affect our bodies, either by reducing their efficiency or making them more dangerous. This includes chemotherapy and other medications.

This is very important for cancer patients to understand, as many people think CBD oil is not a medicine. They think of it more as a vitamin or a supplement, so they might not let their doctors know they’re using it. Patients might not realize it can be potentially harmful. So, it’s very important to tell your doctor if you’re using CBD oil.

Is CBD oil even legal?

CBD has a very complex legal status right now.

At the national level, any product of marijuana — including CBD — is still technically illegal when used medically. Although the 2018 Farm Bill legalized the production of hemp nationally, that’s only permitted if it’s not marketed for medical use or as a dietary supplement. CBD products intended for medical use should undergo an FDA review process.

State laws vary. In Texas, the Compassionate Use Act allows for the use of medical marijuana for certain conditions. Originally only for intractable epilepsy, the law was expanded this year to include cancer and certain neurodegenerative conditions, such as Parkinson’s and multiple sclerosis.

But the application of this law is pretty jumbled right now. So, while it may be legal to use CBD in a state like Colorado or Alaska, if an employer follows federal regulations, the standardization and quality of a CBD product matters. Because if there’s even a small percentage of THC in that product, then a drug test might come back positive. And this could result in legal issues for the user.

What’s the most important thing cancer patients should know about CBD oil?

There’s still a lot to learn. So always let your health care team know if you are using CBD oil. That way, we can make sure nothing interacts adversely with your cancer treatments or other medications.

Also, avoid products with health-related claims on their labels. The only product approved by the FDA for its medical value is Epidiolex.
